Idaho Residency
INITIAL DETERMINATION OF RESIDENCY STATUS
When you apply to Boise State, the university classifies you as either a resident student or a nonresident student based on your application and uses this classification to determine your tuition and fees. For further information, please contact the Admissions Office in the Administration Building, Room 101 or at (208) 426-1156. Students can also contact the Residency Coordinator in the Administration Building, Room 110 or at (208) 426-4249.
HOW DO I BECOME AN IDAHO RESIDENT?
For the purpose of calculating tuition and fees, your status is determined by your responses to several questions on your application for admission. These questions are based on Idaho Code 33-3717. Here are several options, but not the complete and full code.
- A. One or more of your parents/legal guardians or spouse's parents is domiciled in Idaho and has maintained a bona fide domicile[1] in Idaho for at least 12 months prior to the opening day of the term during which you plan to enroll, and you receive at least 50% of your financial support from your parents/legal guardians.
- B. You receive less than 50% of your support from parents/legal guardians and have continuously resided[2] in Idaho for purposes other than education[3] for at least 12 months prior to the opening day of the term in which you plan to enroll.
- C. You are or will be a graduate of an accredited Idaho high school and will attend Boise State University during the term immediately following high school graduation.
- D. You are married to an Idaho resident.
- E. You or your spouse is a member of the Armed Forces[4] stationed in Idaho on military orders.
- F. One or more of your parents/ legal guardians, from whom you receive 50% or more of your support, is a member of the Armed Forces stationed in Idaho.
- G. You are an officer or an enlisted member of the Idaho National Guard.
- H. You have been separated under honorable conditions from the Armed Forces after at least two years of service. At the time of separation, you designated the State of Idaho as your intended domicile or indicated Idaho as your home of record, and you are entering Boise State University within one year of the date of separation.
- I. You have been away from the State of Idaho for a period of less than 30 months. You have not established legal residence elsewhere. You were a resident of the State of Idaho for a continuous 12-month period immediately prior to departure.
- J. You are a member of one of the following Idaho American Indian tribes: Coeur d'Alene, Shoshone-Paiute, Nez Perce, Shoshone-Bannock, Kootenai.
HOW DOES A STUDENT ESTABLISH RESIDENCY IN IDAHO?
A student must be physically present in Idaho for purposes other than education. If the student has been enrolled in 8 or more semester credits at any time during the last 12 months, Idaho considers the student in Idaho for primarily educational purposes and this disqualifies them from establishing residency, unless the student has continuously resided in Idaho for 12 consecutive months and meets one of the following criteria prior to the opening day of the semester:
- 1. The student filed an Idaho state income tax return covering at least 12 months prior to the semester the student is applying for residency.
- 2. The student is a permanent full-time employee in the state of Idaho for a period of at least 12 months before the semester which the student is applying for residency.
- 3. The student has owned their own living quarters for a period of at least 12 months before the semester the student is applying for residency.
- 4. The student establishes of at least 5 of the following 7 factors at least 12 months prior the semester the student is applying for:
- 1. Registration and payment of Idaho taxes or fees on a motor vehicle, motor home, travel trailer, or other item of personal property for which state registration and the payment of a state tax or fee is required;
- 2. Registration to vote for state elected officials in Idaho at a general election;
- 3. Holding an Idaho driver's license or Idaho state-issued ID card;
- 4. Evidence of abandonment of a previous domicile;
- 5. Presence of household goods in Idaho;
- 6. Establishment of accounts with Idaho financial institution.
- 7. Other similar factors indicating intent to be domiciled in Idaho and the maintenance of such domicile. Factors may include, but are not limited to, enrollment of dependent children in Idaho primary or secondary schools, establishment or acceptance of an offer or permanent employment for self in Idaho, or documented need to care for a relative in Idaho.
HOW DOES A STUDENT REQUEST A CHANGE OF RESIDENCY?
Students who feel they have met the qualifications for residency for fee-paying purposes must submit an Idaho Residency Determination Worksheet. The deadline to submit the Idaho Residency Determination Worksheet is the 10th day of the semester the student is applying for residency. Complete the form and return it with the needed documentation to the Registrar's Office located in the Administration Building, Room 110.
[1] Bona fide Domicile is an individual's true, fixed, and permanent home and place of habitation. It is the place where that individual intends to remain, and to which that individual expects to return when that individual leaves without intending to establish a new domicile elsewhere.
[2] Continuously resided is an individual's physical presence in the state of Idaho for 12 consecutive months without being absent from Idaho for more than a total of 30 days.
[3] Purposes other than education means that a student is enrolled in more than 8 credit hours in any semester during the previous 12 month period.
[4] Armed Forces means U.S. Army, Navy, Air Force, Marine Corps, and Coast Guard. It does not include National Guard from a state other than Idaho or other reserve forces.
